Bill of Lading:
18) Matters affecting
performance
If at any time the performance of the contract
evidenced by this Bill of Lading is or is likely to be affected by any
hindrance, risk, delay, difficulty or disadvantage of whatsoever kind which
cannot be avoided by the exercise of reasonable endeavours, the carrier
(whether or not the transport is commenced) may without notice to the merchant
treat the performance of this contract as terminated and place the goods or any
part of them at the merchant’s disposal at any place or port which the Carrier
may deem safe and convenient. Whereupon the responsibility of the Carrier in
respect of such Goods shall cease. The Carrier shall nevertheless be entitled
to full freight and charges on Goods received for transportation and the Merchant
shall pay any additional costs of carriage
to and delivery and
storage at such place or port.
We
regret the troublesome
situation and will endeavor, to the best of our
ability, to provide ocean service to preferred destinations. Shipments from
Gioia Tauro are considered new and therefore will need new bookings with new documentation
requirements.
In
case you want to ship your container from Gioia Tauro to an alternative port,
the requirements are the following:

delivered to the port, we are asking you to either change the destination port
or make arrangements to retrieve your containers from the port.
We recognize the hardship caused by this
situation and we will do our utmost to ease this burden.
